Updating card info for the family
We begin each program with a consultation to assess the student's learning style, determine which tutor will connect best with the student, and set goals for the program. Please use the enrollment form after meeting with one of our directors. To arrange this meeting, contact a director at 1.646.638.3504 or director@tutorassociates.com.
Terms of Service
The following terms are a binding legal agreement between you (hereinafter referred to as “Client”) and Tutor Associates (hereinafter referred to as “TA”). Please read the terms carefully before using the services. Your use of the services means that you (Client) agree to be bound by the following terms.
Billing
Client acknowledges that TA bills in 15-minute increments in order to ensure flexibility of programs and sessions. Client further acknowledges that TA will email invoices every two weeks to the parent email address on file and will charge the provided bank or credit card. TA accepts Visa, Amex, Mastercard, and Discover.
Client understands they will not be billed in advance of a session, and that payments are due on the date specified on the invoice. Client further understands that tutoring will be paused until the balance can be paid in full if payment is not received within 14 days of receiving the invoice.
Rescheduling
Client acknowledges TA will bill at 50% for any session canceled or rescheduled with less than 24 hours notice. Client understands TA tutors will confirm sessions ahead of time, and TA will excuse one last-minute cancellation as a result of sickness per quarter.
Tutoring sessions
Client acknowledges that tutoring sessions are always one-on-one, either in your home or online. Client further acknowledges that an adult does not need to be present in the same room as the session but should be available somewhere in the home.
Non-Solicitation of Tutors
During the period of time during which Client utilizes TA services and for a period of one (1) year following termination of these services, Client may not directly or indirectly solicit or assist any other person or entity in soliciting any TA tutor by whom services were provided to Client to perform tutoring work independently for Client or any other third party. If Client breaches this policy, TA shall be entitled to payment totaling $25,000 from Client for each tutor Client solicited as described above.
Zoom Usage
Client understands that TA uses Google Meet as the primary platform for tutoring sessions, and additionally uses Zoom for testing sessions and consultations. Client further understands that TA is required to consent to educational data collection because TA provides educational services to children under the age of 18. Client affirms they have read Zoom's Children's Educational Privacy statement (https://explore.zoom.us/en/schools-privacy-statement/) and consents to the educational data collection when their child(ren) uses Zoom for remote tutoring or testing sessions.
COVID-19
Vaccinations & Masks
Client understands that:
TA has obtained proof of vaccination for all in-person employees.
TA employees are not required to share proof of vaccination directly with Client.
They will inform TA if their building has a policy requiring non-residents to show proof of vaccination before entering the building.
Masks are optional for employees, students, and members of the student’s household, regardless of vaccination status.
Positive Test Results
Client understands that:
If their child tests positive for COVID-19, TA should be notified.
Tutoring and testing may continue remotely while the child isolates for 5 days or until they are asymptomatic (if symptoms persist beyond 5 days).
The child should wear a mask for an additional 5 days following isolation.
Client understands that:
If another member of their home tests positive for COVID-19 and has been in close contact with a TA employee, in-person work can continue as long as the positive individual is not present.
If any TA employee who has worked in-person with their child tests positive for COVID-19, the employee will isolate for 5 days (or until symptoms have subsided) and close contacts will be notified.
Any TA employees who were exposed while working in-person with their child will be notified.
Exposure
Client understands that:
Exposed and asymptomatic TA employees are permitted to continue working in-person as long as they have been fully vaccinated against COVID-19.
Exposed and symptomatic TA employees will work remotely until symptoms have subsided.
Client understands that:
Exposed and asymptomatic children who have been fully vaccinated against COVID-19 are not required to quarantine or be tested and may continue to work in-person with TA employees.
Exposed and symptomatic children who are fully vaccinated against COVID-19 may resume in-person tutoring and testing once the child’s symptoms have subsided.
Exposed and asymptomatic and symptomatic children who are not fully vaccinated may resume in-person testing and tutoring after a 5-day quarantine period. These students will also need to wear a mask for an additional 5-day period.
Suspected Illness
Client understands that:
If their child or tutor experiences symptoms of a contagious illness (but has not been exposed to COVID-19), in-person work can resume once symptoms have subsided.
If their child exhibits symptoms of contagious illness during an in-person session (but has not been exposed to COVID-19), the rest of the session will be rescheduled for a later time. In-person sessions may resume once symptoms have subsided.
If a proctor notices a child is sick during in-person testing, they will help the child to a quiet room and contact Client for pick-up. In-person testing can resume once symptoms have subsided.
Waiver of Liability Related to COVID-19
Client acknowledges they received a waiver of liability form and a copy of all client policies in the program proposal email sent to them by a TA Program Director following their initial consultation. Client further understands they are expected to sign the waiver of liability form prior to using TA’s services.
Client acknowledges and represents that they have carefully read the Client Policies and Terms of Service. Client further acknowledges and represents that they are completing enrollment voluntarily and in doing so agrees to be bound by the Client Policies and Terms of Service.
Client acknowledges and represents that they and their child(ren) receiving TA tutoring services have carefully read and signed the Waiver of Liability Related to COVID-19. Client further acknowledges and represents that they freely and knowingly assume the risk and waive their rights concerning liability as described in the Waiver of Liability form.
Choice of Law: Client understands and agrees that the law of the State of New York will apply to this contract.
Final Acknowledgment: Client acknowledges and represents that they have carefully read the Client Policies, Terms of Service, and the Waiver of Liability Related to COVID-19. Client further acknowledges and represents that they are signing the Engagement Letter voluntarily and agrees to be bound by it as well as the Client Policies and Terms of Service. Client acknowledges and represents that they and their child(ren) receiving tutoring services from Tutor Associates have carefully read and understand all provisions of the Waiver of Liability Related to COVID-19, and freely and knowingly assume the risk and waive their rights concerning liability as described above.
